Terms of Service

Welcome to Whispering Crystals. These terms of service (“Terms”) are a legal agreement between you (“You” or “User”) and Whispering Crystals (“We,” “Us,” or “Our”). They govern your use of our website, products, and services (the “Platform”).

By accessing, using, or purchasing anything from our Platform, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Platform or our services.

Important Note: We may update these Terms at any time without prior notice. We encourage you to review them regularly. By continuing to use our Platform after any changes, you accept the new Terms.

1. General Conditions

• Age Requirement: You must be at least 18 years old and legally competent to enter into a contract to use our Platform and purchase our products.
• Account and Information: To place an order, you may be required to create an account. You agree to provide accurate, complete, and current information when you register and place an order. You are responsible for keeping your password confidential.
• Identity Verification: You agree to provide valid credentials that we can use to verify your identity. We may suspend or terminate your account if we believe you have breached these Terms.

2. Our Products and Your Responsibility

• Each of our product/service is offered with the intention of bringing positive energy in your life. While we believe that our products and services can improve overall well-being, we are not engaged in any medical practice and do not claim to treat any illnesses of body and mind. Users will be solely responsible for their use of our products and/or services in healing and everyday practices. The crystal stones are selected by the experience of healers and this should not be treated as medical advice or as an alternative to medicines. Whispering Crystals does not guarantee any product or service’s ability to cure any illness and we do not advocate the use of any product and/or service as a substitute for standard medical practice.
• Product Appearance: We strive to display our products as accurately as possible. However, the final product’s appearance, finish, and color may vary slightly from what you see on your screen.
• Pricing and Availability: All prices are in Indian Rupees (INR) and include all applicable taxes. We reserve the right to change prices and product descriptions, or to discontinue any product, at any time without notice. We also reserve the right to limit the quantity of products sold to any person, region, or jurisdiction on a case-by-case basis.

3. Ordering and Shipping

• Order Process: You can place an order using a registered account or by providing your mobile number to receive a one-time password (OTP).
• Payment: We accept pre-paid orders via UPI, e-wallets, debit/credit cards, and net-banking. We also offer EMI and “Pay Later” options.
• Shipping: We use third-party courier services.
  • Domestic (India): Delivery to metro cities is typically 1-3 business days, and 2-7 business days for non-metros, from the date of dispatch. We charge a flat shipping fee of INR 100. Orders over INR 1500 qualify for free shipping.
  • International: Shipping takes 7-21 days from the date of dispatch. Costs vary by shipment size and country. Orders over USD 125 qualify for free shipping.
• Incorrect Information: You are solely responsible for providing accurate shipping and billing information. We are not liable for any loss or damage resulting from inaccurate information you provided.

4. Returns, Refunds, and Cancellations

• Returns Policy: You can only return goods in accordance with these Terms and our separate Returns Policy. Returned items must be in the same condition as when you received them.
• Refunds: If a return is accepted, we will reimburse you within 14 days of receiving the returned goods. The refund will be issued as store credit or via your original payment method, at our discretion.
• Non-Returnable Items: You cannot return or cancel an order for the following:
  • Personalized or custom-made goods.
  • Items that cannot be returned due to their nature (e.g., hygiene products once unsealed).
  • Goods that have been inseparably mixed with other items after delivery.
  • Digital content that has been accessed.

5. Your Content and Our Platform

• Your Submissions: Any comments, reviews, ideas, or other content you send us (“Comments”) can be used by us without restriction. We have no obligation to keep Comments confidential, pay you for them, or respond to them.
• Prohibited Uses: You may not use the Platform or its content for any unlawful purpose, to harass others, to submit false information, to transmit viruses, or to interfere with the Platform’s security. We may terminate your access immediately if we find you are engaging in any of these activities.

6. Disclaimers and Limitation of Liability

• “As Is” Service: Our Platform and all products are provided “as is” and “as available,” without any guarantees. We do not warrant that your use will be uninterrupted, secure, or error-free.
• Third-Party Tools and Sites: We may provide access to third-party tools and websites for your convenience. Your use of these is entirely at your own risk. We are not responsible for any issues or damages that arise from your use of these third-party services.
• Limitation of Liability: Whispering Crystals, our affiliates, and our suppliers will not be liable for any direct, indirect, or consequential damages (including lost profits, data loss, or other financial losses) that result from your use of the Platform or products. You agree to indemnify and hold us harmless from any claims resulting from your breach of these Terms.

7. Termination of Service

• We reserve the right to suspend or terminate your access to the Platform and our services at any time, without prior notice or liability.
• To terminate your own account, you can send an email to info@whisperingcrystals.in with a prior notice.

8. Governing Law and Dispute Resolution

These sections determine how legal issues will be handled.

• Governing Law: The clause “The laws of the Country, excluding its conflicts of law rules, shall govern this Terms” means that any legal dispute will be settled under the laws of India.
• Disputes Resolution: The requirement to “first try to resolve the dispute informally” is a common step that encourages negotiation before resorting to formal legal action, which can be costly and time-consuming for both parties.
